Plant Application - Estimated Time Line and Costs Plant patents are relatively inexpensive, and are reserved for plants that grow or bloom like a flower or fruit. The cost for a plant patent is $1,000 to $1,500. It normally takes about 60 days to have the application “Patent Pending”. This type of patent usually takes 12 to 24 months to issue.The schedule below provides an estimate of the entire process from initial consultation until the patent expires 20 years from date of filing. |
Plant Patent Description of Event 1. Meeting with client, product disclosed. Retainer Paid 2. Application written and sent to client with billing 3. Application returned with signatures and payment 4. Application mailed to PTO 5. Application "Pending" copies sent to client 6. Patent Approved with Notice of Allowance 7. Copies to client with bill for issue & publication fee 8. Payment and client authorization, Documents to PTO 9. Patent issues and sent to client Budgetary Cost Patent Rights end 20 years after the filing date. |
